User - Terms & Conditions of Use
Lode provides a way in which users can communicate requests for Services to Handlers appearing on Lode app. The legal contract for the Services is between the user and the Handler. Lode has no control over the conduct of the user or the Handler.
The Site and the Services are not targeted towards, nor intended for use by, anyone under the age of 18.
If you use the washing service, clothes will be washed in 5kg loads. A load that weighs less than 5kgs will be charged as one 5kg load. A load weighing more than 5kgs will be divided into 5kg bundles and a charge will be made for each bundle.
To use the Site you will need a device or computer that meets the system and compatibility requirements of the Services. This may change from time to time. You are responsible for ensuring that your computer or device is adequate to use this Site and any material contained on it.
License and use of intellectual property
The Lode Site and all images, software, platforms, tools, graphics, data, text, code, the Trademarks (as defined below) and other content and materials available on the Site (including the Services) and the selection and arrangement thereof (collectively, the "Lode Info") are the property of Lode or its third party licensors and are protected Australian and international intellectual property laws.
You acknowledge that (i) all right, title and interest in and to the Lode Info, including all intellectual property rights (including trademarks) and other proprietary rights embodied therein or associated therewith, are and will remain with Lode or its third party licensors and no right or interest in the Lode Info is conveyed other than the limited licenses granted and the Lode Info is protected by copyright and other intellectual property laws.
You acknowledge that "Lode” app, the look and feel of the Site and any slogans of Lode contained on the Site are trademarks of Lode (collectively, the "Trademarks") and may not be copied, imitated or used without the prior written permission of Lode. All other trademarks, registered trademarks, product names and company names or logos contained on the Site or in the Lode Info are the property of their respective owners.
Virus, hacking and other offences
You agree that you will not (i) modify or alter the Lode Info or create derivative works of the Lode Info or decompile, disassemble, decode or reverse engineer the Lode Info, translate the Lode Info or otherwise attempt to learn the source code, structure, algorithms or internal ideas underlying the Lode Info or bypass, delete or disable any copy protection mechanisms or any security mechanisms in the Lode Info.
Except as otherwise expressly permitted herein, you may not use the Site or the Lode Info (even if the Lode Info is received free of charge) for the collection, copying or distribution of any portion of the Lode Info.
You must not misuse the Site by knowingly introducing viruses, trojans, worms, keystroke loggers, spyware, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server in which the Site is stored or any server, computer or database connected to the Site. You must not attach the Site via a denial-of-service attack or a distributed denial-of-service attack.
You may create a text hyperlink to the Site, provided such link does not portray Lode or any of the Lode Info in a false, misleading, derogatory or otherwise defamatory manner. This limited right may be revoked by Lode at any time. You may not frame the Site or utilize framing techniques to enclose the Site or Lode Material or other proprietary information without Lode's express prior written consent.
You accept responsibility for all activities that occur under your user account. We use commercially reasonable security measures to protect your account however, we cannot guarantee absolute security of your account or the Financial Info we collect, and we cannot promise that our security measures will prevent third party "hackers" from illegally accessing the Site or their contents. Lode is not responsible or liable for any third party access to or use of your Financial Info. You agree to immediately notify Lode of any unauthorised use of your account or passwords or any other breach of security, and you accept all risks of unauthorised access to the Financial Info and any other information you provide to Lode.
You agree that you have read and agree to be bound by the Community Guidelines. These Guidelines are updated from time to time and you are therefore requested to review the Guidelines on a regular basis.
Where you are providing feedback or ratings of users (“Feedback”), you agree that you will provide the Feedback honestly. Your Feedback must not contain any language that it likely to be offensive to any third party. We reserve the right to remove any Feedback provided by you for any reason whatsoever.
Formation of contract with Handlers, purchasing and refunds
You will be required to register an account with Lode. At registration, you will need to enter a valid credit/debit card that is registered in your name to your address. Lode outsources the processing of any payments and you will be bound by the terms and conditions of such provider. Lode does not hold your Financial Information.
Once you have selected the services you want, you will be required to click the ‘place order’ button . Prior to clicking the “place order” button, please check that the information is correct as errors cannot be corrected. Once you have clicked the “place order” button, you have entered into an agreement between you and the Handler. The Handler has sole responsibility for the Services.
As the legal contract for the supply of Services is between you and the Handler, Lode does not accept any responsibility or liability for any loss or damage caused due to your use of the Site and/or Services. Lode does not provide any undertaking to you that the Services will be of satisfactory quality or suitable for your purpose. Lode, to the fullest extent possible, disclaims any such warranties.
The timeframes for completion of the Services are set out in the ‘what service to expect’ section of the web page. These timeframes are estimates only and may change.
You agree that the Handler will provide the Service as set out in the ‘what service to expect’ section of the web page. The Handlers will not check pockets for hazards such as coins, keys etc, sort washing, check for colour fastness or individual washing label instructions. Neither the Handler nor Lode are responsible for any loss or damage caused due to colour run, fading or stretching of garments or shrinkage. You are responsible for any loss caused due to any damage caused due to any hazards contained within your washing.
Your contract for the purchase of Services is confirmed once you receive a message from within Lode app confirming your purchase.
Payment for the Services will be deducted from your debit/credit card after the return of your washing/ironing.
If you are dissatisfied with the Services, the Handler or are seeking a refund, then contact should be made directly to the Handler. If you are dissatisfied with any response from the Handler, Lode may (but is not obliged to do so) try and assist you and the Handler to reach a resolution of issues. If Lode provides you with a refund or credit for the Services, the refund of the amounts paid by you for that particular Service is your only remedy.
Third Party Services
Limitation of liability
The Lode Info displayed on the Site and the Services are provided without any guarantees, conditions, warranties as to their accuracy or fitness for purpose. To the extent permitted by law, Lode and the Handlers expressly exclude:
1. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity
2. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the Services, use or downloading of any Lode Info, inability to use the Lode Info, any websites linked to the Site including, without limitation any liability for loss of income or revenue, loss of business, loss of profits, loss of data, loss arising by virtue of a denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs.
The Site and the Lode Info are provided “as is” and on an “as available” basis.
In no event will the aggregate liability of Lode or the Handler, whether in contract, tort, product liability or otherwise, arising out of or in connection to the use (or inability to use) the Site, Lode Info or the Services exceed the amounts paid for any Service.
Applicable Law and Use by International Users
If you access the Site from a country other than Australia, you agree that your transactions with Lode occur in Australia. You are responsible for compliance with all applicable laws, rules and regulations applicable to your use of the Services.
It is not intended that these Services will be used by international users.
Availability of the Site and Lode Materials
Lode reserves the right at any time, at its sole discretion and without notice, to suspend, modify, discontinue or permanently cancel the Site, Services and/or Lode Info or any portions thereof. If the Site, Services or Lode Info, or any part thereof are permanently discontinued or cancelled by Lode, neither Lode or the Handler will have any further liability to you. Neither Lode nor the Handler will have any liability to you for any interruption or unavailability of the Site or the Lode Info.
Closing your account
You may request the closure of your account by sending an email to firstname.lastname@example.org providing clear written notice of such request. When Lode receives your request, Lode will close your account and notify you of such via email. Lode may request additional information from you prior to closing your account.
